Expert Witness Report Critique

Client Challenge:

Cirdan’s client, the leaders of an employee union group, entered a lawsuit asserting that reductions to health benefits had been made in a way that was not permissible. The client did not have in-house expertise on employer benefits, claims data or actuarial soundness requirements.

Our Solution:

• Cirdan reviewed and critiqued the report prepared by the employer’s expert witness as well as the report prepared by the client’s own expert
• Cirdan was able to identify several problematic assertions made by the employer’s expert
• Cirdan drafted questions for our client’s counsel to use during the litigation process

The Result:

Ultimately, our client prevailed in the lawsuit. Assuming the results survive appeal, benefits are expected to be restored for employees.
